1. This site hosts no user-submitted content

There are no uploads, no comments, no forums, no user accounts and no submissions on this site. Every item on it was published by Nikki Kit.

That matters for two reasons. It means we are not an online service provider seeking safe harbour under 17 U.S.C. § 512(c), so no designated agent is registered with the US Copyright Office. And it means that if you believe something here infringes your rights, we can simply deal with it ourselves, which is faster than any formal process. Section 3 tells you how.


2. Our work is protected, and we do enforce it

All content published by Nikki Kit is protected by copyright: video, audio, photography, writing, artwork, branding and site design, wherever it appears. No licence is granted to reproduce, redistribute, resell, mirror, re-upload or repost it, in whole or in part, on any platform, in any format, free or paid.

This includes, and is not limited to:

We send takedown notices to hosts, platforms, CDNs, search engines and payment providers, and we pursue repeat infringers. Statutory damages for wilful infringement of a registered work reach $150,000 per work under 17 U.S.C. § 504(c).

Reporting infringement of our work

Non-consensual intimate imagery

Requests under the Take It Down Act relating to non-consensual or synthetic intimate imagery of the performer are treated as urgent and actioned within 48 hours.


3. If you believe we have infringed your rights

Tell us and we will act. You do not need a lawyer to do this, and we would much rather fix a genuine mistake than argue about one.

Send to legal@nikkikit.com with the subject line "Copyright Notice", including:

  1. Identification of the copyrighted work you say has been infringed
  2. The exact URL on this site where the material appears, so we can find it
  3. Your name and contact details
  4. A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law
  5. A statement that the information in your notice is accurate, and that, under penalty of perjury, you are the copyright owner or authorised to act for them
  6. Your physical or electronic signature

We aim to respond within 5 business days, and we will remove or disable material that is infringing.

Please note: under 17 U.S.C. § 512(f), knowingly misrepresenting that material is infringing carries liability for damages and costs, including legal fees. Send notices in good faith.

Counter-notice

If material of yours was removed and you believe that was a mistake or a misidentification, send a counter-notice to the same address with: identification of the material and where it was; a statement under penalty of perjury that you have a good-faith belief it was removed as a result of mistake or misidentification; your name, address and phone number; and your consent to the jurisdiction of the federal court for your district (or, if outside the US, for the district in which the Company is located).


4. Trade marks

The names, marks, logos and branding used on this site are the property of Nikki Kit and may not be used without written permission, including in a way that suggests an endorsement, partnership or affiliation that does not exist.


5. Requests to use our work

Interviews, press, quotation beyond fair use, collaboration, licensing: just ask. legal@nikkikit.com

Ordinary fair-use quotation, criticism, commentary, news reporting and review do not need permission. Linking to us never needs permission and is always welcome.
